This Privacy Policy describes how Wiretap Labs, LLC (together with its subsidiaries and affiliates, “Wiretap Labs,” “us,” “we,” or “our”) may collect, use, and share your personal information and the rights and choices you may have with respect to your personal information.

Wiretap Labs provides structured content (“Content”), products, software, data, and other advertising and creative services (collectively, and together with the Content, the “Services”) for enterprise IT professionals, tech vendors, and others in the tech community, including IT content creators and publishers. Through its Decision Insights Marketplace (the “Marketplace”), Wiretap Labs supports enterprise IT professionals (“Subscribers”) in their buying journey by providing Content and related products and services to identify, research, and monitor tech vendor news, products, analysis, events, training, and education. Wiretap Labs serves tech vendors, industry and expert analysts, and other IT content creators (collectively, “Contributors”) by distributing their content (e.g., company news, IT conferences, and expert insights) across the Marketplace and third-party media platforms via Wiretap Labs’ StringerAI™ distribution platform, and sharing engagement data with Contributors as it concerns their content. Contributors and third-party media platforms also have the option to place the TapTag™ signal (the “Pixel”) on their website to enable Wiretap to gather viewer engagement metrics.

This Privacy Policy applies to individuals (“Users”) whose personal information is processed by Wiretap Labs in connection with (i) any website, mobile Application, or platform that we own and operate and that links to this Privacy Policy, including wiretaplabs.com, my.decisioninsights.Artificial Intelligence (AI), and stringer.ai (collectively, the “Site”), (ii) receiving our Services, and (iii) our related events, social media pages, email and other electronic communications, and the other services, product offerings, and features that we offer (collectively, and together with the Site and Services, the “Platform”). This Privacy Policy also applies to individuals (“Consumers,” which may include Subscribers) who engage with the Content on the Marketplace or with Contributor and publisher websites that use our Pixel.

COLLECTION OF PERSONAL INFORMATION

We may collect the following categories of personal information about Users and Consumers, respectively. We may also collect other personal information that is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Collection and Sources of User Personal Information

  • Contact information, such as first and last name and company email address, phone number, and mailing address.
  • Professional information, such as company name, job title, company location, and other details we may collect about your business or profession.
  • Account information, such as your log-in details, information that you store in your account, and other details about your use of the Services.
  • Preferences, such as any marketing or communications preferences.
  • Order history, such as records of products and services you have purchased from us.
  • Transaction and billing data, such as payment amounts and payment methods used to complete transactions, and other relevant information about the financial institutions you use to conduct business.
  • Survey responses, such as contact and other information you provide in response to our surveys or questionnaires.
  • Communications, such as the information associated with your requests or inquiries, including for support, assistance, or order information, and any feedback you provide when you communicate with us. If you engage with us through chat, virtual meetings, or by phone, we and our service providers may record that communication for quality assurance, to assist with note taking, for internal training, and for marketing purposes.
  • Online activity information, such as the website you visited before browsing to the Services, pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.
  • Device information, such as your computer or mobile device Operating System (OS) type and version number, wireless carrier, manufacturer and model, browser type, screen resolution, Internet Protocol address, unique identifiers, and general location information such as city, state, or geographic area.

We obtain Users’ personal information from a variety of sources, including from the following sources:

  • Personal Information You Provide. Wiretap Labs collects personal information when you voluntarily submit it to us, such as when you request a demo through our Site, engage our Services, register for an account, or communicate with us. Unless we specifically request it, we ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Platform, or otherwise to us.
  • Personal Information Obtained from Third Parties. Wiretap Labs may receive personal information from third parties, such as our marketing and advertising partners, affiliate networks, data analytics partners, publicly available sources, and data licensors/providers. We may also maintain pages for our company relating to our Platform on social media platforms and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use, and processing of your personal information. You or the platform may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy. We may merge or combine personal information received from third parties with the personal information we collect from you directly or automatically.
  • Referrals. Users may have the opportunity to refer contacts to us and share their contact information. Please do not provide us with someone’s contact information unless you have their permission to do so.
  • Personal Information Automatically Collected. Wiretap Labs, our service providers, and our advertising partners may automatically log information about Users, their computer or mobile device, and a User’s activity over time on our Platform and other sites and online services, such as the online activity information and device information listed above. Like many online services, we use cookies and similar technologies to facilitate some of the automatic data collection described above, such as:
    • Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
    • Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.
    • Local storage, which is used to save data on a visitor’s device. We may use data from local storage for similar reasons as cookies, such as to store multimedia preferences, customize what we show you based on your past interactions with our Platform, remember your preferences, and measure ad effectiveness.
    • Software development kits, or SDKs, are third-party computer codes used in connection with our mobile app for a variety of purposes, including to provide us with analytics regarding the use of our mobile app, to add features or functionality to our mobile app, or to facilitate online advertising. SDKs may enable third parties to collect information directly via our mobile app.

Collection and Sources of Consumer Personal Information

  • Online activity information, such as the website you visited before browsing to the Content or Marketplace, your user agent (e.g., web browser), pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.
  • Device information, such as your computer or mobile device OS type and version number, wireless carrier, manufacturer and model, browser type, screen resolution, Internet Protocol address, unique identifiers, and general location information such as city, state, or geographic area.
  • Engagement data, such as information about content served, viewed, or clicked on such as the type of content, where the content was served, whether you clicked on or viewed it, and the number of times you have seen the content.

We collect the personal information listed above when Consumers engage with the Content on the Marketplace and with content found on publishers’ and Contributors’ websites where our Pixel is placed.

To the extent the Consumer is also a Subscriber, we will match the information above with other personal information we maintain about the Subscriber. For example, we may collect and categorize information about the content on these publisher webpages and link this information to personal information of Subscribers collected through the delivery of our Services. However, we only share resultant company- or firmographic- level data with Contributors and publishers through our Services, as further described in the “Disclosure of Personal Information” section below. We do not disclose to Contributors or publishers any direct identifiers of Consumers or Subscribers.

USE OF PERSONAL INFORMATION

We may use and process personal information collected pertaining to Users and Consumers for the purposes set forth below and as otherwise described in this Privacy Policy or at the time of collection.

  • Research and Development (R&D). We use personal information for R&D purposes, including to study and improve the Platform and our business, understand and analyze the usage trends, demographics, and preferences of our Users, and develop new features, functionality, products, and services.
  • Compliance, Fraud Protection, and Safety. We will use personal information as we believe necessary or appropriate to (a) comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; (b) protect our, your, or others’ rights, privacy, safety or property (including by making and defending legal claims); (c) audit our internal processes for compliance with legal and contractual requirements and internal policies; (d) enforce the terms and conditions that govern the Platform or the respective Services; and (e) prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
  • With Your Consent. We will disclose your personal information in accordance with your prior direction or, in some cases, we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.

Additional Uses of User Personal Information

  • Provide the Platform. Wiretap Labs’ primary purpose in collecting personal information is to provide the Services requested by our Users, or to otherwise provide products or services that you request through our Platform. For example, we use Users’ personal information to (a) establish, manage, monitor, and maintain accounts; (b) improve and personalize your experience on or with the Platform; (c) deliver the type of Content and product offerings that best suit your business needs; (d) verify your identity; (e) provide any surveys you participate in; (f) communicate with you about the Platform, including providing notices about your account, sending announcements, updates, or security alerts, and sending support or administrative messages; (g) respond to any of your requests, feedback, or questions; (h) provide maintenance and support for the Platform; and (i) fulfill any other purpose for which you provide personal information.
  • Send Marketing Communications. We may send you newsletters and other promotional communications as permitted by law, including materials, updates, information, special offers, and promotional material from us and our business partners. You may opt-out of our marketing communications as described in the “Your Choices” section below.
  • Interest-Based Advertising. We may work with third-party advertising companies and social media companies to help us advertise our business and to display ads for our Services and Platform to Users and prospective Users. These companies may use cookies and similar technologies on our Site to collect information about you (including the online activity information and device information described above) over time across our Platform and other websites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. In addition, some of these companies may use hashed User lists that we share with them to deliver ads to you and to similar users on their platforms. You can learn more about your choices for limiting interest-based advertising in the “Your Choices” section below.

Additional Uses of Consumer Personal Information

  • Provide the Services to our Users. Wiretap Labs’ primary purpose in collecting Consumer’s personal information through our Pixel is to provide the Services requested by our Users and to provide engagement data to Contributors and publishers.

DISCLOSURE OF PERSONAL INFORMATION

In addition to the specific situations discussed elsewhere in this Privacy Policy or at the point of collection, Wiretap Labs may share your personal information with the entities or persons listed below.

  • Related Companies. We may share your personal information with our affiliates, subsidiaries, and other related companies.
  • Service Providers. We may share your personal information with third parties who perform services on our behalf that are necessary for the orderly operation of our business. For example, we work with service providers that help us perform Site and survey hosting, maintenance services, database management, analytics, fraud protection, marketing, customer relationship management, finances, and other purposes.
  • Professional Advisors. We may share personal information with persons, companies, or professional firms providing Wiretap Labs with advice and consulting in accounting, administrative, legal, tax, financial, debt collection, and other matters.
  • Authorities and Others for Compliance, Fraud Prevention, and Safety. Under certain circumstances, we may be required to disclose personal information to law enforcement, government authorities, and other parties if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency). We may also disclose personal information in the good faith belief that such action is necessary to comply with a legal obligation or for the purposes described above in the section titled “Compliance, Fraud Prevention, and Safety.”
  • Business Transaction Participants. We may disclose personal information to third parties in connection with any business transaction (or potential transaction) involving a merger, acquisition, sale of shares or assets, financing, consolidation, reorganization, divestiture, or dissolution of all or a portion of our business (including in connection with a bankruptcy or similar proceedings).

Additional Contexts In Which We Disclose User Personal Information

  • Other Users of the Services and the Public. We may provide functionality that enables you to disclose personal information to other Users of the Services or the public. For instance, you may be able to maintain a user profile with information about yourself or your use of the Services that you can make available to other Users within your organization, or the public. You may also be able to submit content to the Services (such as comments, questions, reviews, surveys, blogs, photos, and videos), and we will identify you by displaying information such as your name or username along with the content you submit. We do not control how other Users or third parties use any personal information that you make available to other Users or the public.
  • Advertising Partners. We may share User personal information with third parties who we partner with for advertising campaigns or that collect information about your activity on the Services for the purposes described in the “Interest-Based Advertising” section above.

Additional Contexts In Which We Disclose Consumer Personal Information

  • Contributors. Through our Services, we share firmographic data with Contributors to help them target organizations they want to reach and guide investment or media spend. Firmographic information is derived from personal information but does not directly identify a Consumer or Subscriber. Firmographic information may include industry or vertical, functional area, job title, seniority, predictive signals, location (city or state), and related information about the company.
  • Publishers. We may share firmographic data and engagement data with Contributors and publishers who integrate our Pixel on their website or online service.

YOUR CHOICES

Users can make the following choices regarding their personal information.

  • Review and Request Changes to Your Account Information. In some cases, if you have registered for a certain type of account with us, you may be able to review and request to update certain personal information in your account profile or delete your account by logging into your account or submitting a support ticket.
  • Opt-Out of Marketing Emails. Users may opt-out of marketing-related emails by clicking the “unsubscribe” link at the bottom of the email or by contacting us as provided at the end of this Privacy Policy. You may still receive service-related and other non-marketing communications.
  • Control Cookies & Browser Web Storage. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and it may not work properly. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit allaboutcookies.org. Similarly, your browser settings may allow you to clear your browser web storage.
  • Advertising Choices. You can limit the use of your information for interest-based advertising by blocking third-party cookies in your browser settings, using browser plug-ins/extensions, and/or using your mobile device settings to limit the use of the advertising ID associated with your mobile device. You can also opt out of interest-based ads from companies participating in the following industry opt-out programs by visiting the linked websites: the Network Advertising Initiative (https://www.networkadvertising.org/managing/opt_out.Attestation Service Provider (ASP)), the Digital Advertising Alliance (https://optout.aboutads.info), or the European Interactive Digital Advertising Alliance (https://www.youronlinechoices.eu/). Many of the opt-out preferences described in this section must be set on each device and/or browser for which you want them to apply. Please note that some of the advertising companies we work with may not participate in the opt-out mechanisms described above, so even after opting-out, you may still receive interest-based advertisements from other companies. If you opt-out of interest-based advertisements, you will still see advertisements online but they may be less relevant to you.

  • Do Not Track. Some browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit https://www.allaboutdnt.com.

INTERNATIONAL TRANSFER OF PERSONAL INFORMATION

Wiretap Labs is based in the United States, and we have service providers in the United States and potentially other countries. Your personal information may be collected, used, and stored in these countries or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein.

SECURITY OF PERSONAL INFORMATION

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.

OTHER SITES AND SERVICES

The Platform may contain links to other websites and online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our Content may be included on web pages or online services that are not associated with us. We do not control third party websites or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use, and sharing of your personal information. We encourage you to read the privacy policies of the other websites and online services you use.

NOTICE TO CALIFORNIA RESIDENTS (SHINE THE LIGHT LAW)

Under California Civil Code sections 1798.83-1798.84, California residents who have an established business relationship with Wiretap Labs are entitled to ask us for a notice describing what categories of personal information we share with third parties for the third parties’ direct marketing purposes. If you are a California resident and would like a copy of this notice, please submit your request to the email address listed at the end of this Privacy Policy with “Shine the Light” in the subject line.

NOTICE TO NEVADA RESIDENTS

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the “sale” of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your “sale” opt-out rights, please submit your request to the email address listed at the end of this Privacy Policy with “Nevada Opt-Out” in the subject line.

The information provided in this section applies only to individuals in the European Economic Area, Switzerland, and the United Kingdom (collectively, “Europe”). Except as otherwise specified, references to “personal information” in this Privacy Policy are equivalent to “personal data” governed by European data protection legislation.

Legal Bases for Processing. The legal bases of our processing of your personal information as described in this Privacy Policy will depend on the type of personal information and the specific context in which we process it. However, the legal bases we typically rely on are set out in the table below. We rely on our legitimate interests as our legal basis only where those interests are not overridden by the impact on you (unless we have your consent or our processing is otherwise required or permitted by law). Send Marketing Communications   Processing is based on your consent where that consent is required by applicable law. Where we rely on your consent you have the right to withdraw it any time in the manner indicated when you consented or via the relevant Services. Where such consent is not required by applicable law, we process your personal information for this purpose based on our legitimate interests in promoting our business and providing you with tailored, relevant content.
Interest-Based Advertising
Consumer Personal Information
Provide the Services to our Users Processing through the Pixel is based on our legitimate interest in providing the Services to our Users and providing engagement data to Contributors and publishers who integrate our Pixel, as further described in this Privacy Policy.

Use for New Purposes. We may use your personal information for reasons not described in this Privacy Policy where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

Cross-Border Data Transfer. If we transfer your personal information to a country outside of Europe such that we are required to apply additional safeguards to your personal information under European data protection laws, we will do so. Please contact us at the email address provided at the end of this Privacy Policy for further information about any such transfers or the specific safeguards applied.

CHANGES TO THIS PRIVACY POLICY

Wiretap Labs reserves the right, at any time, to modify this Privacy Policy. If we modify how we collect, use, or share personal information, we will post the updated Privacy Policy on this page. In some cases, we may notify you about an update by sending you an email, posting a notice about the update on the Platform or Services, or other means as may be required by applicable law. In all cases, your continued use of the Platform or Services following posting or other notification of changes constitutes your acknowledgement of such changes.
